Plaintiffs, former Field Supervisors and Operators for Patriot, filed this collective action lawsuit on behalf of themselves and other current and former Field Supervisors and Operators alleging Patriot violated the FLSA and certain state wage laws by not paying certain workers overtime compensation for hours worked over 40 hours in a single workweek. In addition to back wages and unpaid overtime, Plaintiffs are seeking liquidated damages equal to their unpaid overtime (double damages) and attorneys’ fees and costs.

 

Patriot denies the allegations and believes that Field Supervisors and Operators were properly paid under the Fair Labor Standards Act.

 

The Court has not made decisions about this case, or determined whether the workers were properly paid. The Court authorized a notice to go out to advise Class Members of how their rights under the FLSA will be affected by this lawsuit and describe how to participate in this collective action. By returning a Consent to Join Lawsuit Form, you can join this lawsuit, and try to recover damages under federal law during the time period February 11, 2017 to the present.



If you submit a Notice of Consent, you will be part of the case and will be represented by the Plaintiffs’ attorneys. Therefore, if the Plaintiffs who brought this lawsuit win or settle the case, you may receive additional money from Patriot. If the Plaintiff loses the case, you will receive nothing and will be bound by the decision, but you will not have to pay anything either.

 

If you decide to join the lawsuit, you may be required to respond to written requests for information and documents, produce documents, and appear for depositions, hearings, or trial to provide sworn testimony under oath.

 

If you do not wish to be a part of the collective action lawsuit, you do not need to do anything. The decision to join is entirely yours.

 

Because of the statute of limitations, eligible workers who do not join this litigation or choose to file their own separate claims, may lose their rights to recover overtime for work performed in the past for Patriot.
